Terms & Conditions

These terms and conditions apply to the Captain Cook Fiji prize of a cruise for two people on board the MC Caledonian Sky, departing Denarau Marina, Fiji April 20, 2024 in a Deluxe Balcony Suite.

Promoter

The Promoter is Cruise Passenger (Cruise Media Australasia PTY LTD; 33 164 325 866; Suite 206, Level 2, 46a Macleay Street Potts Point 2011 NSW Australia) and the prize shall be provided by Captain Cook Cruises Fiji Cruise Line – ABN 63 001 364 487.

The Prize (“Prize”)

The winner will receive a luxury cruise for two on board MS Caledonian Sky for 7 nights plus return flights from Australia and a hotel stay in Fiji the night before the cruise departs.

Travel dates: 19 April (Flight) + 1-night pre-cruise Accommodation) – Return 28th (Flight)

Cruise dates: Departs 20 April 2024 – Arrives 28 April 2024

The Cruise Prize Includes:

• Food and Beverage: All meals - 24/7 Tea and coffee facilities, Buffet Breakfast and lunch, Afternoon Tea, A la cart dining, canapes at Sunset, traditional tropical island Lovo feast ashore, and all cuisine freshly prepared on-board from local produce.

The Cruise Prize does not include: Day Spa massage and beauty services, SCUBA Diving, Deluxe Private Deck Dinner and Private Beach Cocktails. (These are all optional extras).

Promotion Entry Period:

The promotion entry period commences AEST on 25 November 2023 and concludes on 8 February 2024.

It will be promoted via the Cruise Passenger website, eNewsletter, website and social media channels.

Entrants

  1. Entry is open to Australian residents (excluding South Australia) only who are 18 years and over. Entry is via an online form on Cruisepassenger.com.au which will include First name, last name and email address and phone number
  2. Proof of eligibility must be provided upon request. Employees of Captain Cook Cruises and/or any of its Group Companies, subsidiaries, affiliates (including any relatives, family members and/or household members) and anyone else professionally associated with this Promotion are expressly excluded from entering.
  3. Only one entry per entrant will be accepted. Multiple email addresses for the same person will not be permitted or accepted.
  4. Entries must be received before the Closing Date. Late, incomplete, invalid and/or corrupt submissions will not be accepted and will be disqualified. No responsibility will be accepted by the Promoter and/or Captain Cook Cruises Fiji for lost entries and proof of transmission will not be accepted as proof of receipt.
  5. It is a condition of entry that the winner (and their travel companion) must agree to: (i) take part in any and all activities determined by Captain Cook Cruises Fiji including, without limitation, video filming and/or publicity relating to this competition; and (ii) be available to travel on the Prize sailing date.

Selection of Winner(s)

  1. The winner will be chosen at random by Cruise Passenger at 10am on February 15, 2024 at Cruise Passenger’s office 46a Macleay St, Potts Point, 2011, from valid entries received before the Closing Date and the winner will be notified by Cruise Passenger, by phone and email within 7 days of the draw. The winner will be published in Cruise Passenger eNewsletter on Friday, February 15, 2024.
  2. If the winner does respond or cannot be contacted, a redraw will occur on Friday, February 9 at 10am 2023 at Cruise Passenger’s office 46a Macleay St, Potts Point, 2011, and posted in the Cruise Passenger eNewsletter on Friday, February 16.
  3. The winning email notification will include instructions on how/by when the winner is to claim their Prize and provide passenger details, where applicable. Failure to claim and/or provide such details within the required time frame may result in forfeiture of the Prize.
  4. The Prize cruise must be confirmed no later than 30 days after the winner has been notified that they have won the Prize.
  5. In the event that a winner declines the Prize, and/or is unable to take the Prize, and/or fails to respond within the required time frame, and/or does not claim/take the Prize, and/or is ineligible or otherwise unable to claim the Prize, the winner shall forfeit the Prize and the Captain Cook Cruises Fiji shall have no liability to the winner and reserves the right in its absolute and sole discretion to select another winner


Travel and Health Requirements

  1. The winner(s) and, where applicable, their travel companions, will be responsible for ensuring and checking that they (i) hold any and all documentation required in order to travel including, without limitation, ensuring that they are in possession of valid passports with an expiry date no earlier than six months after the completion of the Prize cruise and apply and/or have any visas and/or other permits required for travel; and (ii) have adequate and comprehensive travel insurance (evidence of which shall be provided to Captain Cook Cruises Fiji if requested); and (iii) comply with any and all health and other requirements for travel including, without limitation, any required vaccinations, health certifications and/or permits.
  2. Prior to departure, the winner(s) are required to check, without limitation, the Captain Cook Cruise Fiji website, the FCDO travel advice website and the equivalent country websites of the countries being visited as part of the cruise, for the latest advice and information about travel documentation, procedures, facilities, policies, health and safety information and vaccination & health requirements

General terms and conditions

  1. By entering this Promotion, entrants are considered to have agreed, without limitation, to these terms and conditions and Captain Cook Cruises Fiji Booking Terms and Conditions and Cruise Passengers Terms and conditions.
  2. The Prize is subject to these terms and conditions and Captain Cook Cruises Fiji or Cruise Media Australasia reserves the right, to amend and/or update, without limitation, these terms and conditions and/or the Captain Cook Cruises Fiji Booking Conditions, conditions of carriage and/or privacy policy(ies) at any time.
  3. The winner(s) must submit all the necessary information in the manner prescribed and by the dates prescribed, to be entitled to claim their Prize.
  4. The fulfilment of the Prize will be managed by Captain Cook Cruises Fiji
  5. Captain Cook Cruises Fiji reserves the right, in its sole and absolute discretion, to: (i) cancel, suspend, and/or modify this Promotion, or any part of it, if any fraud, technical failures, a change in applicable law or any other factor beyond Captain Cook Cruises Fiji’s reasonable control impairs the integrity and/or proper functioning of this Promotion; (ii) reject any entries and/or disqualify any entrants, at any time, if Captain Cook Cruises Fiji’s in its sole and absolute discretion deems that there has been or may be, whether intended or otherwise, any: (a) breach of any of these terms and conditions; and/or (b) infringement or potential infringement of any third-party rights and/or intellectual property; and/or (c) defamation or potential defamation of any persons, companies, intellectual property, institutions, cultures or similar; and/or (d) offence or potential offence caused, howsoever arising; and/or (e) breach of any laws, regulations, codes (including moral codes), uses, guidelines and/or any other generally accepted etiquette rules required (without limitation) from any internet users, platforms, providers, hosts and/or sites and/or similar.
  6. The Prize is as described, is not transferable, cannot be amended or varied, has no cash value (and cannot be exchanged for cash) and cannot be re-sold.
  7. Captain Cook Cruises Fiji reserves the right, in its sole and absolute discretion, to change the Prize and/or substitute any or all of the Prize with an alternative Prize.
  8. The winner(s) may be required to take part in publicity resulting from the Promotion. Captain Cook Cruises Fiji shall be entitled to make use, in any way and/or through any medium, of any comments provided and/or made by the winner(s) including, without limitation, those provided by the winner(s) on any social media sites and/or Captain Cook Cruises Fiji-owned marketing channels (including the Captain Cook Cruises Fiji’s website), for the benefit of promoting Captain Cook Cruises Fiji and its Group and/or associated companies, subject to the applicable policies of the relevant social media sites and/or marketing channels.
  9. In entering the Promotion, entrants agree not to post any detrimental content on any social media platform and/or in any other mediums.
  10. The determination and decision of Captain Cook Cruises Fiji on all matters shall be final and no correspondence or discussion will be entered into (including as to the winner(s)).
  11. Captain Cook Cruises Fiji reserves the right in its reasonable discretion to: (i) disqualify any entrant, claimant, competitor or their guest whose conduct is contrary to the spirit of the rules or the intention of the Promotion and to declare as void any or all of their claims or entries based on such conduct; (ii) declare as void any claims or entries resulting from any printing, production and/or distribution errors (including without limitation any error(s) on any website and/or app of Captain Cook Cruises Fiji and/or in any published materials, regardless of format) and/or where there has been error(s) in any aspect of the preparation for or conduct of the Promotion that materially affects the result of the Promotion and/or the number of entrants, claimants and/or the value of claims; (iii) add to or waive any rules and/or terms and conditions at any time; and/or (iv) cancel the Promotion or any part of it, at any stage, in the event of circumstances beyond Captain Cook Cruises Fiji’s reasonable control.
  12. Captain Cook Cruises Fiji reserves the right to cancel, suspend and/or amend/modify this Promotion and/or the Prize, or any part of it and at any time, if any fraud, technical failures, change in applicable law(s) or any other factor beyond Captain Cook Cruises Fiji’s reasonable control impairs the integrity or proper functioning of the Promotion, as determined by Captain Cook Cruises Fiji in its sole and absolute discretion.
  13. Insofar as is permitted by law, Captain Cook Cruises Fiji, its employees, agents, subcontractors and/or or distributors will not in any circumstances be responsible or liable for: (i) any loss (including, without limitation, indirect, special or consequential loss or loss of profits), damage, cost, compensation and/or other expense which is suffered and/or sustained by any party (whether or not arising from any person’s negligence) in connection with this Promotion and/or in accepting and/or using the Prize [and/or its contents and/or their ingredients]; and/or (ii) any personal injury or death occurring as a result of taking up/accepting the Prize, except where it is caused by the negligence of Captain Cook Cruises Fiji and/or , its employees and, where it is responsible for them, its agents and/or distributors. The winner(s)’s statutory rights shall not be affected.
  14. The winner shall be liable for complying with any fiscal and/or tax requirements (including, without limitation, any benefit-in-kind declarations and/or calculations) and other legal obligations and/or requirements arising out of, or in connection with, the Prize.
  15. This Promotion shall be subject to the laws of New South Wales and the exclusive jurisdiction of the New South Wales Courts.

Personal Data

  1. Any personal information and/or data provided during the entry process (including, without limitation, the entrant’s name) must be valid, up to date and truthful.
  2. Captain Cook Cruises Fiji accepts no responsibility or liability for any incorrect, false or fictitious personal information provided to it.
  3. Captain Cook Cruises Fiji and Cruise Media Australasia shall use the entrants’ personal data (including, without limitation, the winner and their companion’s names, addresses, and emails) for the purpose of administering and/or promoting this Promotion. If entrants wish to opt-out at any time by writing to Captain Cook Cruises Fiji or by clicking the unsubscribe link in any message received.
  4. Subject to Captain Cook Cruises Fiji’s privacy policy and these terms and conditions, the winner(s) title, surname and county: (i) may be announced on the Captain Cook Cruises Fiji Facebook, Twitter and/or Instagram accounts, as well as on its blog and in other marketing material for a period of 6 months following the announcement of the winner of the Promotion.
  5. By entering the competition, entrants agreed to opt in and receive marketing communications from Captain Cook Cruises Fiji and Cruise Media Australasia.
  6. By entering the competition, entrants agreed to opt in and receive marketing communications from Ambassador Cruise Line and Cruise Passenger.
